Terms of Service

Welcome to Wax Trader. These Terms of Service ("Terms") govern your access to and use of the Wax Trader website, mobile applications, and services (collectively, the "Platform") operated by Wax Trader LLC ("Wax Trader," "we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
1. Acceptance of Terms
By creating an account, browsing, or making any purchase or sale on the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Refund & Return Policy, and our Shipping Policy, each of which is incorporated herein by reference.
2. Eligibility
To use the Platform, you must:
- Be at least 18 years of age.
- Be a legal resident of, or authorized to conduct business in, the United States.
- Have the legal capacity to enter into a binding agreement under applicable law.
- Not have been previously suspended or removed from the Platform.
By using the Platform, you represent and warrant that you meet all of the above eligibility requirements.
3. Account Registration & Security
To access certain features of the Platform, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate and complete.
- Keep your login credentials confidential and not share them with any third party.
- Accept responsibility for all activity that occurs under your account.
- Notify us immediately at hello@waxtrader.io if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that contain inaccurate information, are used for fraudulent activity, or violate these Terms.
4. Marketplace Rules
4.1 Role of Wax Trader
Wax Trader operates as a marketplace platform that facilitates transactions between buyers and sellers. Wax Trader is not a party to the transaction between buyers and sellers. We do not own, possess, or ship the products listed on the Platform. The contract of sale is directly between the buyer and the seller.
4.2 Buyer Obligations
As a buyer, you agree to:
- Provide accurate shipping and payment information at checkout.
- Pay the full purchase price, including applicable taxes, at the time of checkout.
- Report any issues with your order within 30 calendar days of the estimated delivery date.
- Communicate respectfully with sellers when resolving any issues.
- Not initiate chargebacks through your payment provider without first attempting to resolve the issue through Wax Trader's dispute resolution process.
4.3 Seller Obligations
As a seller, you agree to:
- List only authentic, factory-sealed products that you own and have the right to sell.
- Provide accurate descriptions, images, and pricing for all listings.
- Maintain accurate inventory counts and promptly update or remove listings for items that are no longer available.
- Ship orders within the stated timeframes: 1–2 business days for fast shipping sellers, or 3–5 business days for standard sellers.
- Package items securely to prevent damage during transit.
- Provide accurate tracking information for all shipments.
- Respond to buyer inquiries and resolve issues promptly and professionally.
- Complete Stripe Connect onboarding to receive payouts.
- Comply with all applicable laws, regulations, and tax obligations.
5. Fees & Payments
5.1 Buyer Fees
There are no buyer fees on Wax Trader. Buyers pay the listed product price plus applicable sales tax. Shipping is free on all orders.
5.2 Seller Fees
Sellers are subject to the following fees:
- Platform Fee: Base 5% of the gross order amount (subtotal + shipping + tax), with lower rates available for eligible tier sellers. This fee is deducted from seller payouts.
- Stripe Processing Fee: 2.9% + $0.30 per transaction, as set by Stripe. This fee is deducted from seller payouts.
There are no listing fees, subscription fees, or other hidden costs. Sellers only pay fees when a sale is completed. Wax Trader reserves the right to modify fees with prior notice to sellers.
5.3 Payment Processing
All payments are processed through Stripe, a PCI Level 1 certified payment processor. By using the Platform, you agree to Stripe's Terms of Service and Privacy Policy.
5.4 Seller Payouts
Seller payouts are delivery-based: payouts are processed 1 day after carrier delivery confirmation, or 15 days after order creation if delivery cannot be confirmed. Payouts are transferred to the bank account configured through Stripe Connect. Payouts may be held if there is an open dispute, your Stripe account requires additional verification, or an administrative hold is in place.
5.5 Taxes
Sales tax is collected from buyers at checkout based on the shipping destination and is remitted by Wax Trader in accordance with applicable law. Sellers are responsible for their own income tax obligations arising from sales on the Platform.
6. Shipping & Delivery
All shipping on Wax Trader is free for buyers. Sellers are responsible for shipping costs and for complying with the Shipping Policy, including packaging requirements, shipping timeframes, and providing tracking information. Delivery timeframes are estimates and Wax Trader is not liable for carrier delays.
7. Refunds & Returns
Refunds and returns are governed by our Refund & Return Policy. In summary, buyers may request a refund within 30 calendar days of the estimated delivery date for items that are not as described, damaged in transit, not delivered, counterfeit, or incorrect. Refunds are processed back to the original payment method within 5–10 business days after approval.
8. Buyer Protection Program
Every purchase on Wax Trader is covered by our Buyer Protection Guarantee. If an item is not as described, damaged in transit, not delivered, or counterfeit, we will work with the buyer and seller to reach a fair resolution, including full refunds where warranted. The Buyer Protection program is subject to the terms and limitations described in our Refund & Return Policy and these Terms.
9. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Listing, selling, or promoting counterfeit, stolen, or illegally obtained products.
- Providing false, misleading, or inaccurate information in listings, profiles, or communications.
- Manipulating prices, feedback, ratings, or search results.
- Circumventing fees by completing transactions outside of the Platform.
- Harassing, threatening, or abusing other users.
- Creating multiple accounts to evade suspension or restrictions.
- Using automated tools (bots, scrapers, etc.) to access the Platform without prior written consent.
- Interfering with the Platform's infrastructure, security, or proper functioning.
- Violating any applicable local, state, national, or international law or regulation.
- Initiating fraudulent chargebacks or payment disputes.
Violation of these prohibitions may result in immediate account suspension or termination, withholding of funds, and/or legal action.
10. Intellectual Property
The Wax Trader name, logo, branding, website design, and all original content on the Platform are the intellectual property of Wax Trader LLC and are protected by applicable copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, or distribute any of our intellectual property without prior written consent.
Product names, brand names, and images listed on the Platform (including but not limited to Topps, Panini, Upper Deck, Bowman, and others) are trademarks of their respective owners. Wax Trader is not affiliated with or endorsed by any card manufacturer unless explicitly stated.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAX TRADER LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
Wax Trader acts as a marketplace facilitator and does not guarantee the quality, safety, legality, or authenticity of items listed by sellers, although we take reasonable measures to verify sellers and enforce our policies. Our total aggregate liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amounts paid by or to you through the Platform in the twelve (12) months preceding the claim.
12. Dispute Resolution
12.1 Between Buyers and Sellers
Disputes between buyers and sellers should first be resolved through direct communication using the Platform's messaging system. If a resolution cannot be reached, either party may escalate the dispute to Wax Trader support. We will review the evidence and make a determination in accordance with our policies. Our determination is final with respect to Platform-related remedies (refunds, payouts, etc.).
12.2 Between You and Wax Trader
Any dispute arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Pinellas County, Florida. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or representative proceeding.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Pinellas County, Florida.
14. Modifications to Terms
Wax Trader reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date at the top of this page. For significant changes, we may also send an email notification to registered users. Your continued use of the Platform after the effective date of any modification constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.
